‘Bong’ lands Club X in court

A MILDURA adult shop claims an “oil pourer” it had on display cannot be used for smoking cannabis.

The implement has landed Club-X Pty Ltd in the Mildura Magistrates’ Court, where it is contesting police allegations the product can be used as a bong. 

The water pipe will now be the subject of a contested hearing in December, when Club-X will defend its right to display the product.

Club-X’s counsel told the court yesterday the product could not physically be used as a bong because it was missing a critical component.

“Some people might refer to it as a cone – it hasn’t got it,” the shop’s lawyer said.

Police have argued the product was designed without a cone to “circumvent” legislation banning shops from displaying or selling bongs and that modifications could allow it to be used to smoke cannabis.

The shop’s lawyer said relevant legislation was “strange” because shops are allowed to display as many as three hookahs, used for smoking shisha, which can also be used to smoke cannabis.

A Club-X staff member and two police informants will be required to give evidence at the contested hearing.
