Servo bid before VCAT: Council’s formal refusal too late as applicant goes to tribunal

A PLAN to build a service station in Deakin Avenue has been referred to the Victorian Civil and Administrative Tribunal (VCAT), the applicant says.

Councillors formalised their refusal to grant the permit for the development at Thursday night’s Mildura Council meeting, after the matter lapsed without a formal decision being made at the previous meeting.

However, Fisher Planning director Warrick Fisher said the decision was “null and void” as the matter was already out of the council’s hands.
